The Ministry of Transport of Russia posted a draft order on regulation.gov.ru, which will prescribe new requirements for parking lots for trucks and buses organized “within the boundaries of urban settlements, districts”.
The Law "On Road Safety" obliges carriers to "ensure" parking of vehicles in accordance with the requirements of the order of the Ministry of Transport No. 199 (effective from January 1, 2020). This order will be canceled on September 1, 2021, and a new document will come into effect instead.
The order will exclude the norm prohibiting "the creation of parking lots in the common area within the boundaries of an element of the planning structure, built up with apartment buildings." In other words, trucks and buses can again be left in parking lots organized in residential areas.
According to the Kommersant newspaper, initially the idea to oblige business to provide trucks and buses with separate parking lots belonged to the State Duma deputies, who prescribed this norm in the Law on Road Safety. It was designed to combat the chaotic parking of commercial vehicles inside neighborhoods. The ban was supposed to be controlled by employees of Rostransnadzor, who could deprive the company of licenses if the parking was not organized according to the rules, the Ministry of Transport explained.
However, for a year since the entry into force, the norm did not work, since the Code of Administrative Offenses did not prescribe sanctions for a truck or bus left in the parking lot near the house. In addition, the Law "On Road Safety" allows a departmental order to establish requirements for the parking lots themselves, but not for their location. According to the Federal Law "On Mandatory Requirements in the Russian Federation" that entered into force in November 2020, a departmental act cannot establish "unnecessary requirements in relation to the law," that is, an act of the ministry cannot determine the requirements for the placement of parking lots for trucks and buses.
